Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and the developer of Sage: Menopause & Peri Tracker ("Sage", "we", "us"). They govern your use of the Sage iOS application (the "App"). Section 4 also governs your use of the blog articles and printable tools published at sagemenopause.com (together, the "Blog and Printable Content"). Please read these Terms carefully before downloading or using the App. By downloading or using Sage, or by accessing or printing any Blog and Printable Content, you agree to be bound by these Terms. If you do not agree, do not use them.

1. About Sage

Sage: Menopause & Peri Tracker is a personal symptom-tracking application designed for women navigating perimenopause and menopause. It allows users to log daily symptoms, identify patterns, track triggers, and generate PDF reports for personal use and discussion with healthcare providers.

Sage is intended for informational and self-tracking purposes only. It is not cleared or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device.

2. Eligibility

You must be at least 18 years of age to use Sage. By using the app, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use Sage.

3. License grant

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Sage on a device that you own or control, solely for your personal, non-commercial purposes.

This license does not allow you to:

• Copy, modify, adapt, translate, or create derivative works of the app
• Reverse engineer, disassemble, decompile, or attempt to extract the source code
• Sell, sublicense, rent, lease, or otherwise transfer rights to the app
• Use the app for any commercial purpose or for any public display
• Remove or alter any proprietary notices, labels, or marks
• Use the app in any way that violates applicable law

This license is also subject to Apple's App Store Terms of Service, which are incorporated herein by reference.

4. Blog articles and printable tools

Our blog articles, guides, printable symptom trackers and worksheets, checklists, templates, page layouts, symptom lists and rating scales, illustrations, graphics, and other materials we publish on our website (together, "Blog and Printable Content") are provided for your personal, non-commercial use only.

What you may do:

• Read the Blog and Printable Content and print a reasonable number of copies of any printable tool for your own personal use, or to share with your own healthcare provider.
• Link to any blog article or printable tool from your own website, social media, or messages.
• Quote short excerpts of an article (no more than a few sentences) with clear attribution and a link back to the original page.

What you may not do without our prior written permission:

• Copy, reproduce, republish, upload, post, host, or redistribute any Blog and Printable Content — in whole or in substantial part — on any other website, app, platform, newsletter, marketplace, or printed publication.
• Sell, license, rent, or otherwise commercially exploit any printable tool, template, article, or other Blog and Printable Content, including bundling it into paid products, courses, memberships, or downloads.
• Modify, translate, rebrand, or create derivative works from any Blog and Printable Content, including recreating our printable trackers or worksheets with altered wording, layout, or branding.
• Remove, obscure, or alter any copyright notice, Sage branding, URL, or attribution that appears on Blog and Printable Content.
• Use any Blog and Printable Content in connection with a competing product or service, or to develop, train, fine-tune, or evaluate any machine learning or artificial intelligence model.
• Use bots, crawlers, scrapers, or other automated means to access, copy, or extract Blog and Printable Content, except for search engines indexing publicly available pages in accordance with our robots.txt file.
• Frame or mirror any blog article or printable tool, or present it in a way that suggests it is your own or that you are affiliated with or endorsed by Sage.

Printable tools are provided free of charge as a convenience. They are personal self-tracking aids, not medical forms, and the medical disclaimer in Section 7 applies to them in full.

To request permission to reuse any Blog and Printable Content (for example, in a clinic, support group, or publication), contact us at [email protected]. We are generally happy to grant permission for non-commercial healthcare and educational use with attribution.

5. Subscriptions and billing

Sage offers a free tier and an optional Premium subscription. All subscriptions are managed through and billed by Apple via the App Store.

• Monthly plan: Price displayed in the App Store at the time of purchase.
• Annual plan: Price displayed in the App Store at the time of purchase.
• Free trial: 7 days at no charge. Your paid subscription begins automatically when the trial ends unless you cancel at least 24 hours before the trial expires.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled. Your Apple ID account will be charged within 24 hours prior to the end of the current period. Renewal prices are subject to change with notice.

Cancellation: You may cancel at any time through Apple ID Settings → Your Name → Subscriptions → Sage. Cancellation takes effect at the end of the current billing period. You retain access to Premium features until that date.

Refunds: We do not offer refunds for subscription fees already charged, except as required by applicable law or Apple's refund policies. To request a refund, contact Apple directly through reportaproblem.apple.com.

EU/UK users — right of withdrawal: If you are located in the European Union or United Kingdom, you have the right to withdraw from a subscription within 14 days of purchase without giving any reason, provided you have not already used the Premium features. To exercise this right, contact us at [email protected] before initiating a refund request through Apple.

Price changes: We reserve the right to modify subscription prices. We will provide reasonable advance notice of any price changes. Your continued subscription after the price change takes effect constitutes acceptance of the new price.

6. Your content and data

All data you enter into Sage — symptoms, moods, notes, triggers, quick logs, and preferences — is stored locally on your device. You own your data entirely. We do not access, collect, store, or process your health data on any server.

You are solely responsible for:

• Maintaining backups of your data (e.g., through iOS device backups)
• Any data you choose to share using the Doctor Report PDF feature
• Keeping your device secure to prevent unauthorized access to your health information

We are not responsible for any loss of data resulting from device loss, damage, theft, failure, or your choice to delete the app or its data.

7. Medical disclaimer

Sage is a personal wellness and self-tracking tool. The following apply without exception:

• Sage is not a medical device as defined by the FDA or any other regulatory authority.
• Sage does not provide medical diagnoses, clinical assessments, treatment recommendations, or professional medical advice.
• The insights, trends, and reports generated by Sage are based on self-reported data and are for informational purposes only.
• Nothing in Sage should be construed as a substitute for professional medical advice, diagnosis, or treatment.
• Always seek the advice of a qualified physician, OB/GYN, or other licensed healthcare professional with any questions you have regarding your health, symptoms, or medical conditions.
• Never disregard professional medical advice or delay seeking treatment because of information in this app.
• In a medical emergency, call your local emergency services immediately (911 in the US, 999 in the UK, 000 in Australia, 112 in the EU).

8. Acceptable use

You agree to use Sage, and any Blog and Printable Content, only for lawful purposes and in accordance with these Terms. You agree not to use them in any way that violates applicable federal, state, local, or international law; to transmit unsolicited advertising; to impersonate any person or entity; or to engage in any conduct that restricts or inhibits anyone else's use of Sage or the Blog and Printable Content.

9. Intellectual property

Sage and all of its original content, features, design, and functionality — including the App's user interface, screens, symptom taxonomy, rating scales, insights logic, report formats, and illustrations — along with the Blog and Printable Content described in Section 4, are and will remain the exclusive property of the developer and are protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and other countries. All rights not expressly granted to you in these Terms are reserved.

The name "Sage", "Sage: Menopause & Peri Tracker", the Sage leaf logo, and associated branding, colors, and visual identity are trademarks or trade dress of the developer. You may not use them, or any confusingly similar name, logo, or design, in connection with any product, service, website, app, or publication without our prior written consent, and you may not use them in any way that could imply endorsement, sponsorship, or affiliation.

Nothing in these Terms grants you any right, title, or interest in Sage or any Blog and Printable Content other than the limited licenses expressly set out in Sections 3 and 4. Any unauthorized use automatically terminates those licenses.

The Outfit font used in Sage is licensed under the SIL Open Font License. Firebase, RevenueCat, Apple, and other third-party services and marks are the property of their respective owners.

10. Copyright and trademark complaints

If you believe that content in the App or our Blog and Printable Content infringes your copyright or trademark, or if you have found our articles, printable tools, or branding being copied or redistributed elsewhere, please email [email protected] with the subject line "Copyright notice" and include: (a) a description of the work you believe is infringed; (b) the URL or location of the material in question; (c) your name, email address, and, if applicable, the organization you represent; and (d) a statement that you have a good-faith belief that the use is not authorized. We take copyright and trademark infringement seriously and will respond promptly, including by pursuing takedown notices and other remedies available under the Digital Millennium Copyright Act (DMCA) and equivalent laws.

11. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAGE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OBTAINED FROM USING THE APP WILL BE ACCURATE OR RELIABLE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAGE, ITS DEVELOPER, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless the developer from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of Sage. This indemnification does not apply to claims arising from the acts or omissions of third-party services integrated into Sage (including Firebase, RevenueCat, or Apple), which are governed solely by their respective terms.

14. Third-party services

Sage integrates with third-party services including Firebase (Google LLC), RevenueCat, and Apple's App Store. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices, availability, or actions of these third parties.

15. Termination

We reserve the right to terminate or suspend your access to Sage at any time, without prior notice, for conduct that we believe violates these Terms or applicable law, or for any other reason at our sole discretion. Upon termination, your license to use the App terminates immediately, and your license to use any Blog and Printable Content terminates if you violate Section 4; in that case you must stop using and destroy any copies of that content in your possession. Sections 4, 7, 9, 10, 11, 12, 13, and 16 shall survive termination.

16. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. However, if you are a consumer residing in the European Union or United Kingdom, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence, which these Terms do not override.

For users residing outside the EU/UK: any dispute arising out of or relating to these Terms that cannot be resolved informally shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive your right to participate in class action lawsuits or class-wide arbitration.

For users residing in the EU or UK: the arbitration clause and class action waiver above do not apply to you. You retain the right to bring claims in the courts of your country of residence.

To initiate a dispute, contact us first at [email protected]. We will attempt to resolve any dispute informally within 30 days before any formal proceedings may be initiated.

17. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top and, for material changes, provide notice through the App. Your continued use of Sage, or of the Blog and Printable Content, after the revised Terms take effect constitutes your acceptance of the changes.

18. Entire agreement

These Terms, together with our Privacy Policy and Apple's App Store Terms of Service, constitute the entire agreement between you and us regarding Sage and the Blog and Printable Content, and supersede all prior agreements, understandings, or representations. If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
